NOTICE
OF INTENT TO
TERMINATE RENTAL AGREEMENT
FOR NON-PAYMENT OF RENT

Please
be advised that as of [date rent was due], rent for your apartment was in
arrears in the amount of $ [total amount owed].
As provided in your Rental Agreement, this sum includes the applicable
late charges in the amount of $ [specify amount of late fees] per [specify
period, e.g. per day], which continues to accrue.
Pursuant
to Section 33-1368(B) of the Arizona Revised Statutes, you are hereby notified
that your failure to pay the above amount within five (5) days from the date of
this notice will, without further act or notice by the owner, result in the
immediate termination of your Rental Agreement.
If
you fail to pay the above-stated amount within five (5) days from your receipt
of this letter, and continue to occupy the apartment past the termination date,
legal action will be brought against you for eviction and recovery of
possession, monetary damages, reasonable attorneys' fees and costs.
Furthermore, if your occupancy beyond the termination date is
intentional, then, pursuant to Section 33-1375 of the Arizona Revised Statutes,
you may also be subject to additional damages equal to twice your monthly rent,
or twice the landlord=s
actual damages, whichever is greater. Furthermore,
please be advised that you are not allowed to use your security deposit as rent.
In
the event you fail to pay the rent within the time specified above, you must
vacate the premises, and leave the premises in a clean condition without any
damage. You will remain liable for
the entire term of your Rental Agreement until and unless the landlord is able
to relet the premises.
